New 2024 Title IX Policies
The 2024 Title IX Regulations have taken effect as of August 1, 2024. These policies will be applicable to any and all claims that take place after August 1, 2024 and are reported after August 1, 2024. Those policies are linked below:
UCASD Policy Code 103 Discrimination/Harassment Affecting Students (07.31.2024)
UCASD Policy Code 103.1 Nondiscrimination - Qualified Students with Disabilities (07.31.2024)
UCASD Policy Code 104 Discrimination/Harassment Affecting Staff (07.31.2024)
2020 Title IX Policies
While new Title IX Regulations have taken effect in 2024, the previous 2020 Title IX Regulations will remain in effect for any claims reported after August 1, 2024 but took place prior to August 1, 2024. For that reason, we have included the most recent, previously adopted UCASD School Board of Directors policies covering claims that fall under those regulations and processes:
Filing a Report
For a claim pertaining to conduct occuring AFTER August 1, 2024, please follow these procedures and guidelines: The Board encourages students and third parties who believe they or others have been subject to Title IX sex discrimination, including sex-based sex harassment, and any other discrimination or harassment as defined in this Policy and Board Policies 103 and 104, to promptly report such incidents to any District employee (but preferably the building principal) or the Title IX Coordinator. A person who is not an intended victim or target of discrimination but is adversely affected by the offensive conduct may file a report of discrimination.
The student’s parents/guardian or any other person with knowledge of conduct that may violate this Policy is encouraged to immediately report the matter to any District employee (but preferably the building principal) or the Title IX Coordinator.
The complainant (the alleged victim) or the individual making the report may use the Discrimination/ Harassment/Bullying/Hazing/Dating Violence/Retaliation Report Form (also an Attachment to Policies 103/104) which has been developed for purposes of reporting an incident or incidents in writing; however, verbal reports of an incident or incidents shall be accepted, documented and the procedures of this Policy and the relevant attachments followed. A copy of this Report Form can be accessed on the District’s website at www.ucasd.org and through the building principal or the Title IX Coordinator. The rights of complainants and respondents (the accused) are outlined in detail in Policies 103/104 and associated Attachments, which outline the District’s applicable Grievance Procedures.
For a claim brought after August 1, 2024 but pertaining to conduct occuring PRIOR to August 1, 2024, please follow these procedures and guidelines: Reports can be made at any time, including during non-business hours, by using the Title IX Coordinator’s listed telephone number or e-mail address, or by any other means that results in the Title IX Coordinator receiving the person’s verbal or written report. As per UCASD School Board policy, the complainant or the individual making the report may use the Report Form for Discrimination, Sexual Harrassment, Bullying, Hazing, Dating Violence, and Retaliation for purposes of reporting an incident or incidents in writing; however, verbal reports of an incident or incidents shall be accepted and documented as per School Board policy. Please feel free to review the UCASD Discrimination Complaint Procedures (2020) and UCASD Title IX Sexual Harassment Procedures and Grievance Process for Formal Complaints (2020) and reach out to the Title IX Coordinator with any questions.
